Privacy Policy

This Privacy Policy (“Policy” or “Privacy Policy”) describes how 1-2 Special Inc. (“1-2 Special,” “Company,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information about you when individuals interact with us in an individual capacity (collectively, “Customers”) and when they apply for job with us or interact with us in a commercial or business-to-business capacity (“B2B Individuals”). This Privacy Policy applies to personal information about you as a Customer or B2B Individual wherever this Privacy Policy is made available to you and personal information collected, whether through our online or offline sites and services (collectively, the “Site(s)” or “Service(s)”), and describes your rights and choices with respect to our processing of such personal information about you.

We partner with various third parties (e.g. platforms and applications) through which you can access our Services (“Business Partners”). This Privacy Policy does not govern information collected by our Business Partners. Our Business Partners are independently owned and operated and we does not manage or control them or their data practices. For details about our processing of data from Business Partners (“Business Partner Data”), please see the “From Our Business Partners” section below.

I. Collection and Use of Personal Information

The following describes the categories of Personal Information about CUSTOMERS that we collect and the purposes for that collection:

  • Personal Identifiers, such as name, postal/mailing address, telephone/mobile number, title, email address, and username/password for your account with us. We use this information to manage your purchases, services, and refunds; personalize your experience with us, including to send you promotion communications; provide you with customer service; process your requests; notify you if you are given a promotion; and inform you and serve you ads about the Services and new products, features, updates, and special promotions, including third-party offers or products we think you might like.

  • Commercial Information, such as content viewed, watched, and purchased, and other purchasing or consuming histories or tendencies. We use this information to manage your purchases, services, and refunds; personalize your experience with us, including to send you promotion communications; provide you with customer service; process your requests; notify you if you are given a promotion; and inform you and serve you ads about the Services and new products, features, updates, and special promotions, including third-party offers or products we think you might like.

  • Financial Information, such as billing address, payment type or method, and charge or credit card number. We use this information to complete transactions and other purchasing activities that you request.

  • Device, Internet and Network Activity Information, and Online Identifiers, such as your IP address, device type and settings, device identifiers, browser type and settings, operating system, ISP and mobile network provider, web beacons, pixels, and usage information (like the time and date of your visits, the content viewed and for how long, etc.). We use this information to personalize your experience with us, including promotional communications; provide access to our Services in a form that can be viewed most easily from your device; determine the general geographic region from which you are accessing the Services, using your IP address, which allows us to present appropriate content and inform you of special rules or rights that may apply to people in your jurisdiction; review statistical information about the use of the systems in order to improve their design and functionality, to understand how they are used, and to assist us with resolving questions; recognize you, your device or your browser when you use our Services so that we can facilitate navigation and display information more effectively; track responses to our e-mails and advertisements; inform you and serve you ads about the Services and new products, features, updates, and special promotions, including third-party offers or products we think you might like.

  • Demographic Information, such as country of residence. We use this information to personalize your experience with us, including to send promotion communications; confirm eligibility for participation in activities such special events and promotions.

  • General location information, such as zip code and IP address. We use this information to manage your purchases, services, and refunds; personalize your experience with us, including to send you promotion communications; provide you with customer service; process your requests; notify you if you are given a promotion; and inform you and serve you ads about the Services and new products, features, updates, and special promotions, including third-party offers or products we think you might like.

  • Audio and Visual Information, such as video footage/photos and audio recordings. We collect this information when you are at our physical locations, at one of our events, in order to participate in one of our promotions, or contact customer support. We use this information to provide you access to our premises, events, and promotions as applicable and to maintain the security of our premises, events, and promotions and the safety of others.

  • Inferences drawn from Personal Identifiers, Commercial Information, Demographic Information, Device, Internet and Network Information, and Online Identifiers, and General Location Information. We use these inferences to manage your purchases, services, and refunds; personalize your experience with us, including to send you promotion communications; provide you with customer service; process your requests; notify you if you are given a promotion; and inform you and serve you ads about the Services and new products, features, updates, and special promotions, including third-party offers or products we think you might like.

The following describes the categories of Personal Information about JOB APPLICANTS that we collect and the purposes for that collection.

  • Personal Identifiers, such as name, postal/mailing address, telephone/mobile number, title, and email address.

  • Professional or Employment-Related Information, such as name of organization and dealings with us on behalf of yourself or a relevant B2B Partner.

  • Device, Internet and Network Activity Information, and Online Identifiers, such as your IP address, device type and settings, device identifiers, browser type and settings, operating system, ISP and mobile network provider, web beacons, pixels, and usage information (like the time and date of your visits, the content viewed and for how long, etc.).

We use all of the categories above to process your business, including providing, researching, developing and improving products and services; executing and processing agreements; managing relationships, including development, execution and analysis of market surveys and marketing strategies; advertising and marketing products and services; and communicating with you.

For ALL USERS (I.E., CUSTOMERS, JOB APPLICANTS, AND B2B INDIVIDUALS), we use all of the categories described above for the following purposes:

  • If we determine a policy violation has occurred, to enforce our rights, or to enforce agreements;

  • If we believe such processing is necessary to identify, contact, or bring legal action regarding the rights and property of ourselves or our affiliates;

  • To enforce our rights or protect against unauthorized access to our systems, premises, events and promotions, or other inappropriate use of our Services, products, or other services;

  • To comply with laws, regulations, court orders and subpoenas or similar requests for information by authorities;

  • To protect your safety and the safety of others;

  • To perform audits;

  • To contact you about Sites, policy, and terms updates;

  • For research and analytics, including to identify usage trends, and to improve and update our products and services, and

  • To assist us in fraud prevention or investigation, all on the basis of our legitimate interest in the continuation of our commercial activities and the protection of our rights.

We retain the Personal Information we collect for as long as is needed to carry out the purposes described above and in accordance with our obligations and rights under applicable law.

Non-Personal Information. We may collect, use and share aggregate or de-identified information that does not identify you and publicly available information except as prohibited by applicable law.

II. Sources of Personal Information/Use of Cookies and Similar Technologies

The sources of the Personal Information we collect include:

Directly from You. For example, when you:

  • Register for an account

  • Make a purchase through our Services

  • Attend an event

  • Sign up to receive promotional communications

  • Enter a promotion

  • Submit a request to or contact our customer service team

  • Apply for a job through our Sites

Automatically through Cookies and Similar Technologies. For example, when you:

  • Visit and navigate our Services on any device

  • View and watch content

  • Enable location-based features on our Services

  • Click on sponsored links or third-party advertisements

Our Services collect Device, Internet and Network Activity Information, and Online Identifiers about you through the use cookies and other similar technologies placed by COMPANY and third parties (collectively, “Cookies”). A “cookie” is a tiny file that is stored on your device (e.g., your computer or mobile device). It contains a unique identifier, as well as the address and other information about the site you are visiting. Some cookies are essential in order to enable you to move around our Services, and visit our Sites and use their features. Other cookies collect information about how visitors use the Sites (for instance, which pages visitors go to most often, and if they get error messages from web pages).

We and third parties may also utilize other similar technologies like pixels, flash objects, APIs, and mobile software development kits (SDKs) and tags. These are small strings of code that are placed on our Sites, in the emails we send to you, or in our digital advertisements. When you access a page or platform containing one of these technologies, you establish a communication with a web server, which collects certain information about your computer or device.

These Cookies allow us and third-party partners to (i) collect Personal Information about you over time and across different websites, apps, and devices when you use our Services, (ii) facilitate Site administration and navigation, (iii) better understand and improve our Services, (iv) determine and improve the advertising shown to you here or elsewhere, and (v) provide you with a rich user experience. For example, where permitted by law, we use third-party vendors to record your interactions with and usage of our website, including the features you engage with, how you navigate, and your click/touch, movement, scroll, and keystroke activity, to support and improve the functionality and performance of our websites. We also use third-party Cookies (such as the Google Analytics cookie) to inform, optimize, and display ads based on your past visits to the Sites, where permitted by law. Our first party tracking technologies do not track our visitors off our Site. Both first party and third party tracking technologies are not used on every page of our Site, nor for every user visit.

From Service Providers. For example, we work with service providers who collect Personal Information on our behalf in order to provide services to us, such as to:

  • Offer and improve products and services

  • Provide IT development and support

  • Host and carry out marketing and business studies and marketing campaigns

  • Verify your information

  • Authenticate payments and process orders and payments

  • Provide fulfillment services

  • Provide delivery services

From Our Business Partners. We may receive Personal Information about you from Business Partners. For example, when you:

  • Register for an account with the platform that provides you with access to our Services.

  • Attend an event

  • Sign up to receive promotional communications

  • Enter a promotion

Data we receive from Business Partners may include all categories of Personal Information listed above. Our processing of Business Partners Data is governed by the terms of our agreements with our Business Partners, and not this Privacy Policy. However, in the event we are permitted to process Business Partners Data for our own purposes, we will process the Business Partners Data in accordance with the practices described in this Privacy Policy.

From Other Entities. We may receive Personal Information about you from other sources. For example, this may include receiving Personal Information from:

  • Business Partners that let us know you have entered into and/or are entitled to a promotion.

  • Social media sites, including Facebook, YouTube, and Instagram. The information we receive from these social media sites is dependent upon the social media site’s policies and your settings on that site, which you can control. For more information about how you can customize your privacy settings and how such social media sites treat Personal Information, please refer to their privacy policies and terms of use.

  • Other websites, including those of non-Business Partners, marketing affiliate sites, online advertising networks, and analytics vendors.

  • Companies that provide Personal Information to supplement what we already know about you, including data aggregators and trade publications. Certain parties might link your name or email address to other information they have collected. That might include past activity on our Services made offline or online. It might also include Device, Internet and Network Activity Information, Online Identifiers (IP Address, cookie IDs and Device IDs).

From Publicly Available and Government Sources. For example, we collect:

  • Information in the public domain

  • Data available in open government databases to help us with fraud monitoring and prevention, compliance with applicable law and regulations, reviewing and processing your employment application and other information

By Combining Personal Information. For example, we may:

  • Combine Personal Information that we collect offline with Personal Information we collect through our Services

  • Combine Personal Information we collect about you from the different devices you use to access our Services

  • Combine Personal Information we get from third parties with Personal Information we already have about you

III. Disclosures of Personal Information to Others

We disclose the Personal Information collected under this Policy in the following ways:

Internally: We disclose all categories of Personal Information listed above with other Company businesses who jointly use Personal Information for the purposes described in this Privacy Policy, where this is acceptable under applicable law.

Business Partners: We disclose all categories of Personal Information with Business Partners to comply with your requests, provide the Services, promotions, and events, respond to your questions, and otherwise comply with the law. We also disclose Device, Internet and Network Activity Information, and Online Identifiers to Business Partners for their advertising and marketing purposes. Business Partners are independent entities, and their processing of information is subject to our agreements with them and their own privacy policies.

A Business That Acquires Us or Our Assets, in a Business Transfer: If another party acquires all or substantially all of our assets, or we enter into negotiations for the same, all categories of Personal Information listed above, and any other information that we have collected in connection with the Services, may be transferred to that party as part of our business assets and the negotiation process. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information will be considered part of our assets that can be sold or transferred to third parties.

Government Authorities, Legal Rights and Actions. We will disclose all categories of Personal Information listed above with various government agencies if required or requested to do so by law, or if we believe such action is necessary or advisable in order to: (1) conform to the requirements of the law or comply with valid legal process served upon us; (2) protect or defend our legal rights or property, the Services, or our customers or users; (3) investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or violations of our Terms of Use; and/or (4) any other reason in our sole discretion. We may also use IP address or other Device, Internet and Network Activity Information, Online Identifiers to identify users, and may do so in cooperation with copyright owners, Internet Service Providers, wireless service providers or law enforcement agencies in our discretion. Such disclosures may be carried out without notice to you.

Third Parties. With your consent (or where you do not object where permitted by law), we disclose General Location Information, Device, Internet and Network Activity Information, and Online Identifiers to third parties, such as our advertising and marketing partners, media partners and platforms, data analytics providers, social networks, and Business Partners to serve your interest-based advertisements and content. If you do consent (or do not object where permitted by law) to have your

Personal Information shared, your Personal Information will be disclosed for targeted advertising to such third parties. We also use audience matching services (which is a type of targeted advertising) to reach people (or people similar to people) who have visited our Sites or are identified in one or more of our databases (“Matched Ads”).

This is done by us providing a list of hashed email addresses to an ad partner or incorporating a pixel from an ad partner into our own Sites, and the ad partner matching common factors between our data and their data. For instance, we may incorporate the Facebook pixel on our Site and may share your email address with

Facebook to create custom audiences for serving ads on Facebook properties. Some ad partners may provide us with their own data, which is then uploaded into another technology service for matching common factors between those datasets.

Service Providers: We disclose all categories of Personal Information listed above with Service Providers as necessary to perform services on our behalf, such as payment processing, email marketing, website and content analytics, marketing and promotions, advertising technology services, cloud data storage, technology support, and customer service.

Facilitating Requests: We disclose all of the categories of Personal Information listed above at your request or direction.

Consent: We disclose all of the categories of Personal Information listed above if we have let you know what information will be shared, with whom, for what purposes, and obtained your consent as required by law.

IV. Your Rights and Choices

Opting-Out of Cookies

  • Cookies and Pixels. Most browsers accept cookies by default. You can instruct your browser, by changing its settings, to decline or delete cookies. If you use multiple browsers on your device, you will need to instruct each browser separately. Your ability to limit cookies is subject to your browser settings and limitations.

  • Do Not Track. Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Note, however, there is no industry consensus as to what site and app operators should do with regard to these signals. Accordingly, unless and until the law is interpreted to require us to do so, we do not monitor or take action with respect to “Do Not Track” signals.

  • Google Opt-Out. Google requires you to opt out directly with them. You may control your advertising preferences or opt out of certain Google advertising products by visiting the Google Ads Preferences Manager, currently available at https://google.com/ads/preferences.   • DAA Opt-Out. Most companies we work with to provide you with targeted ads are participants of the Digital Advertising Alliance (“DAA”). To learn more about the targeted ads provided by these companies, and how to opt out of receiving certain targeted ads from them, please visit: (i) for website targeted ads from DAA participants, https://www.aboutads.info/choices; and (ii) for app targeted ads from DAA participants, https://www.aboutads.info/appchoices. Opting out only means that the selected participants should no longer deliver certain targeted ads to you, but does not mean you will no longer receive any targeted content and/or ads (e.g., in connection with the participants’ other customers or from other technology services).

  • You may also limit our use of information collected from or about your mobile device for purposes of serving targeted ads to you by going to your device settings and turning off interest-based advertising. To opt out of us using your data for Matched Ads, please contact us as set forth in the “Contact Us” section below and specify that you wish to opt out of Matched Ads. Please note that if you opt out using any of these methods, the opt out will only apply to the specific browser or device from which you opt out. We are not responsible for the effectiveness of, or compliance with, any opt out options or programs, or the accuracy of any other entities’ statements regarding their opt out options or programs.

Promotional Communications

You can opt-out of receiving promotional emails from us at any time by following the instructions to click on the unsubscribe link at the bottom of our emails. Please note that you cannot opt-out of non-promotional emails, such as those about your account, transactions, servicing, or our ongoing business relations. Please note that your opt-out is limited to the email address used and will not affect subsequent subscriptions.

Accounts

You can visit the account section of the Services to access, remove, or update certain account information we have on file about you and that you have submitted through the Services. Alternatively, you may use the “Contact Us” section below to request that it be updated or removed. We may require additional information from you to allow us to confirm your identity. Please note that if you ask us to remove information, we will remove it from consumer-facing parts of the Services but may continue to store and use the information for internal analytics purposes or as otherwise permitted under applicable law. We will retain and use your information as necessary to comply with our legal obligations or data retention policies, resolve disputes, and enforce our agreements.

V. Security of Personal Information

We take reasonable steps, including technical and organizational measures, to protect the security and integrity of the Personal Information we process. However, please note we cannot guarantee that any information transmitted through the Internet or stored on our system or otherwise in our care will be completely safe from prohibited intrusion by others, or from access alteration or loss, as no data transmission or storage is perfectly secure. As such, we cannot warrant the security of any information you provide or transmit to us.

VI. Other Important Information

Transfers and Storage of Personal Information

We are based in the U.S. and our Services are targeted to individuals in the United States and Canada. If you reside in a country other than the United States, you should be aware that the data that we collect from you will be transferred to, and stored in the United States. The laws of the United States may not protect the privacy of your information at the same level as provided by the laws of your country.

Links to Other Websites, Content, and Resources

When you use the Services, you may sometimes be directed by links or other means to third-party websites and services that are not affiliated with the Websites or with us. When you go to unrelated websites or services, please note that we do not control

their privacy and security. They may send their own cookies or other tracking technology to visitors or solicit and use your information in different ways than those described in this Privacy Policy. We cannot provide you with any information about third-party practices or the information collected or used by third-party websites or resources. Please exercise caution when you leave our Services for different websites or content, and review the applicable privacy notices.

Minor Children

The Services are directed to general adult audiences and are intended to be used only by persons who are at least 18 years of age. We do not and will not knowingly collect or process Personal Information from anyone we know to be under 18 years of age.

We will delete any Personal Information collected that we later determine to be from a user younger than the age of eighteen (18) in accordance with our legal obligations.

Changes to this Privacy Policy

This Privacy Policy reflects our current practices, and is subject to change and update from time to time. We will notify you about changes by prominently posting a notice on our Sites and modifying the “Effective Date” at the top of this Privacy Policy to indicate when such changes have come into effect, or otherwise as required by law. If we change this Privacy Policy in a material way, we will inform you through a noticeadvising of such change at the beginning of this Privacy Policy and on our Sites.
